Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the SocialSqueeze platform (“Service”), operated by Maverick Innovation LLC (“Company,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

“Account” means your registered account on the Service.
“Content” means any text, images, videos, audio, data, or other materials you upload, create, or transmit through the Service.
“Platform” means the SocialSqueeze web application available at create.socialsqueeze.ai and any related services.
“Third-Party Services” means external platforms you connect to through the Service, including but not limited to Facebook, Instagram, Threads, YouTube, Google Business Profile, LinkedIn, X (Twitter), TikTok, Pinterest, Bluesky, and email service providers.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

To use the Service, you must create an Account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain the security of your password and Account credentials.
Promptly notify us of any unauthorized use of your Account.
Accept responsibility for all activity that occurs under your Account.

4. Service Description

SocialSqueeze is a social media management and content creation platform that provides:

Content Creation: AI-assisted campaign creation, brand kits, media library, video editing, and content templates.
Social Publishing: Connect your social media accounts to schedule and publish content across multiple platforms.
ChatSqueeze: Automated direct message management, conversation flows, triggers, and templates for social messaging.
MailSqueeze: Email marketing tools including domain management, contact lists, email warmup, campaigns, and analytics.
Site Builder: Website generation and management tools.
Analytics: Performance tracking across connected platforms and campaigns.

5. Plans and Billing

The Service is offered under the following plan tiers: Free, Basic, Pro, and Enterprise. Paid plans are billed on a monthly or annual basis as selected at the time of purchase. By selecting a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

Free Trial: Certain paid plans may include a free trial period. If you do not cancel before the trial ends, you will be charged for the selected plan.
Upgrades and Downgrades: You may change your plan at any time. Changes take effect at the start of the next billing cycle.
Refunds: Payments are non-refundable except where required by applicable law.
AI Credits: Plans include a monthly allocation of AI credits. Unused credits do not roll over to the next billing period.

6. Third-Party Service Connections

The Service allows you to connect Third-Party Services via OAuth or other authentication methods. By connecting a Third-Party Service, you:

Authorize us to access your Third-Party Service account to the extent permitted by the access scopes you approve.
Acknowledge that your use of Third-Party Services is governed by their respective terms of service and privacy policies.
Understand that we store authentication tokens securely to maintain your connection and that you may disconnect any Third-Party Service at any time.
Accept that we are not responsible for any changes, outages, or limitations imposed by Third-Party Services.

7. Your Content

You retain all ownership rights to your Content. By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your Content solely for the purpose of providing the Service to you. We do not claim ownership of your Content and will not use it for any purpose other than operating the Service.

You are solely responsible for your Content and for ensuring it complies with applicable laws and the terms of any connected Third-Party Services.
You represent that you have all necessary rights and permissions to use and publish your Content.
We reserve the right to remove Content that violates these Terms or applicable law.

8. AI-Generated Content

The Service uses artificial intelligence to assist with content creation, suggestions, and automation. You acknowledge that:

AI-generated content may not always be accurate, complete, or appropriate. You are responsible for reviewing and approving all content before publishing.
AI-generated content does not constitute professional advice of any kind.
You are solely responsible for any content you publish, whether created manually or with AI assistance.

9. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
Send unsolicited messages, spam, or bulk communications through the Service.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.
Use the Service to distribute malware, viruses, or other harmful code.
Scrape, crawl, or use automated means to access the Service except through our published APIs.
Resell, sublicense, or redistribute access to the Service without our prior written consent.
Use the Service in a manner that violates the terms of any connected Third-Party Service.

10. Email Sending (MailSqueeze)

If you use the MailSqueeze email features, you additionally agree to:

Comply with the CAN-SPAM Act, GDPR, and all applicable anti-spam and data protection laws.
Only send emails to recipients who have provided valid consent to receive communications from you.
Include a functioning unsubscribe mechanism in all commercial emails.
Maintain accurate sender information and not use deceptive subject lines.
Accept that we may suspend or terminate your email sending privileges if we detect abuse or excessive bounce/complaint rates.

11. Automated Messaging (ChatSqueeze)

If you use the ChatSqueeze messaging automation features, you additionally agree to:

Comply with all applicable laws regarding automated messaging, including platform-specific rules for Facebook, Instagram, and other connected services.
Not use automated messaging for harassment, deception, or any unlawful purpose.
Ensure that your automated flows and triggers comply with the terms of service of each connected Third-Party Service.
Accept that Third-Party Services may impose rate limits, restrictions, or penalties on automated messaging that are outside our control.

12. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by the Company and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except the limited right to use it in accordance with these Terms.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

14. Data Security

We implement commercially reasonable security measures to protect your data, including encryption of sensitive credentials and authentication tokens. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your Account credentials.

15. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

17. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT ANY CONTENT GENERATED BY AI WILL BE ACCURATE OR SUITABLE FOR ANY PARTICULAR PURPOSE.

18. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your Content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.

19. Termination

By You: You may cancel your Account at any time through the Service or by contacting us at support@socialsqueeze.ai. Cancellation takes effect at the end of your current billing period.
By Us: We may suspend or terminate your Account if you violate these Terms, engage in abusive behavior, or if required by law. We will make reasonable efforts to notify you before termination except in cases of severe violations.
Effect of Termination: Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period. You remain responsible for any fees incurred prior to termination.

20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas. You consent to the personal jurisdiction of such courts.

22. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
